It’s hard to get and keep the attention of a class of fourth graders. Judge Tierra Jones and Judge Eric Johnson kept the attention of two fourth grade classes from Grant M. Bowler Elementary School in Logandale, NV and taught them some valuable lessons on the justice system when they put on a mock trial in District Court. The mini legal eagles got into their roles as judges, jurors, attorneys, witnesses and marshals in a trial to determine if legendary wizard Harry Potter was guilty of the misuse of magic. After hearing the testimony with built in hints on how courts work, the fourth grader found Potter not-guilty. The students peered into the holding cell which gave them a stark view of what happens to those who get caught in the justice system.

Two more classes from Grant M. Bowler will visit the court on Friday, Nov. 16 from 9:30 a.m. to noon.  Judge Kerry Earley in courtroom 12D  and Judge Adrianna Escobar will host the mock trials.

The mock trials are a cooperative effort between the Nevada Eighth Judicial District Court, nonprofit agency Project REAL and the school. In preparation for the student mock trials, Project REAL provides teachers lessons to convey the roles and processes of a criminal trial. The students get an immersive, real-world learning experience, with the benefit of Project Real classroom lessons to set the stage for better understanding. The students embark on their journey through the justice system with the legal terms and other information provided in the classroom sessions.

District Court Judge Doug Herndon envisioned the mock trial program. He wrote the script involving Harry Potter to provide a fun and interesting method for young students to learn about the justice system. The activities promote the importance of education, highlight potential legal careers and demonstrate the outcome of bad choices.

Project REAL, a 501(c)3 non-profit organization, was founded in 2005 by Sam Lionel and Irwin Molasky to meet the challenge of teaching K-12th grade Nevada students the importance of the law. They have taught over 160,000 Nevada students about the importance of the law with the goal of preparing them to be informed, law-abiding and participating citizens through their programs Your Day in Court, Play By the Rules, REAL Drama, and Independence & You. Chronic absence correlated to high dropout rates has long been an issue in Nevada’s public schools. A recent report shows recent improvement in Clark County graduation rates. According to the Clark County School District (CCSD), one of the key programs to combat habitual absenteeism is the Truancy Diversion Program (TDP). As the school year winds down, it is a perfect time to recognize Truancy Diversion Program volunteers who commit to a school-year of weekly truancy diversion court sessions to keep kids in school and on track to graduate. The volunteer judges/mentors will be recognized on Friday, May 18 from noon to 2 p.m. at the Social Club Ballroom at Main Street Station 200 N. Main Street. The volunteers will be given an award and the opportunity to share their experiences of helping students attain an education. The TDP volunteers see first-hand how keeping a student in school can be the difference between failure and graduation; and between a path of crime and a path of success.

District Court Judge William Voy currently oversee the TDP that was established by Judge Gerald Hardcastle in 2002, and overseen by Judge Jennifer Elliott in collaboration with the Clark County School District (CCSD) for 10 years. “As a judge who hears juvenile cases, I see firsthand the importance of education and graduation. The Truancy Diversion program has proven to be an effective part of the strategy to keep students in school and on track to graduate. The volunteers are key to this much-needed program, and their work has done much to improve the path of many students,” said Judge Voy. “The Truancy Diversion Program not only benefits those students who are struggling to complete their education, but it benefits our community as a whole.”

In the 2016/2017 school-year, the TDP was in more than 80 CCSD elementary, middle schools and high schools. In the 2017/2018 school year, the TDP program plummeted to 40 participating schools, due to the ending of grant for the program from the Office of Juvenile Justice Department of Prevention Keeping Kids in School and Out of Court (OJJDP). Since the grant expired, funding has been an issue, since each school must use school funds to pay for the program.

Those without a high school diploma face higher prospects of unemployment and the associated negative consequences. This collaborative effort between the CCSD has been structured to prevent and reduce youth crime, re-engage students in learning, and ultimately, reduce potential costs to our welfare and justice systems. It is a non-punitive, incentive-based approach to at-risk school students with truancy problems. “Kids who successfully complete school have a much better chance at success in life than those who drop out,” said Presiding Family Court Judge Bryce Duckworth. “Truancy is often the first step off the path to success. The Truancy Diversion Program addresses the issue and keeps students in school and on track to graduate.”

Judges, attorneys, mental health professionals and law enforcement officers volunteer approximately three hours each week to hold truancy court sessions at schools. They promote and support academic achievement using a team effort and an individual student success plan with students and their parents. They review the students’ attendance, school work, and progress to ensure that students have the resources they need to be successful. The goal of the Eighth Judicial District Court Family Division is to continue to expand until all Clark County schools have a TDP program.

The Family Court youth programs are a great example of how the Eighth Judicial District Court is using alternative, efficient methods to address crime and ensure justice. District Court continuously works to develop innovative ideas, improve efficiency, address issues and improve access to justice

Two classes of third graders from the Las Vegas Day School held mock trials in Judge Jennifer Togliatti’s courtroom. The first class put fairy-tale sweetheart Goldilocks on trial for bad manners. Junior attorneys called witnesses including the entire Bear family and presented evidence including Baby Bear’s broken chair. A jury of her peers took copious notes, deliberated and found the accused guilty. Goldilocks was cuffed.

The second class heard the case against the Big Bad Wolf, who now goes by B. B. Wolf. An expert witness and others testified against the wolf who claimed he was just paying a visit to a friend.

The mock trials are a fun way for young students to learn about the justice system and get a feel for legal careers.

Four fourth grade classes from Liliam Lujan Hickey Elementary School experienced justice in action at the Eighth Judicial District Court in early April. They  also got a view on where life-choices lead when they sat in on actual criminal calendars and saw judges, court employees and attorneys perform their jobs. They watched defendants in various stages of their cases, including sentencing. After viewing the calendar, students asked judges questions about  what they saw, and how and why it works that way. The Q&A session was followed by a mock trial of Harry Potter, who was charged with misappropriation of magic. The school visits are part of a new joint program between nonprofit agency Project Real, the District Court and schools.

The mock trial program is intended to contrast the view of careers in the justice system against the choice to get involved in criminal activity. This collaboration between the courts, Project Real and Hickey Elementary School involved a lot of work on the part of the judges and their departments in District Court, Project Real, and the teachers. Thanks to the many people who helped to make it come together so that the students could benefit from a real-world perspective.

Judge Kathleen Delaney had a fifth grade class from St. Viator’s sit in on her calendar. After watching the wheels of justice turn in the courtroom, the wheels in the students’ minds were turning. They asked the judge some very thoughtful questions. One student got a big laugh when he asked the judge if she ever got frustrated with what happens in court.

Students from the UNLV William S. Boyd School of Law spent part of their spring break in an alternative program where they learn about the practice of law and the courts. They sat in on court, attended a judges meeting and got some Q&A time in with the judges.

District Court is involved in a number of initiatives to educate students about the justice system.

Fourth grade students from Rundle Elementary School had an eye-opening experience when they sat through Nevada Eighth Judicial District Court Judge Doug Herndon’s actual criminal calendar. The students reacted when the judge sentenced an armed robber to six to 20 years. One students remarked that he hadn’t even been alive that long. Judge Herndon and Judge Linda Bell fielded questions from the kids after the criminal calendar and before the students took on roles of judge, jury, attorneys, witnesses and marshals for a Harry Potter mock trial. Two classes were part of the pilot-program done in coordination with Project REAL. The activities are intended to teach students about the justice system, possible career opportunities and the consequences of criminal activities. A highlight for the kids was a taser demonstration conducted by District Court Marshal Tom Lemke.

Judge Herndon envisioned this mock trial program and wrote the script as a way to provide a fun and interesting way for young students to learn about the justice system. “This program is a good way for young students to see the legal profession in action. When they watch actual court proceedings, they see the unfortunate consequences of criminal activity,” said Judge Herndon. “The mock trials give the students a way to relate to and understand the justice system, and to see career roles that they may want to consider in the future.”

Rundle Elementary is the first Clark County School District school to participate in this mock trial program. “We appreciate the teachers and principal bringing their students to watch a criminal court and participate in a mock trial,” said Judge Bell. “These kids are at the perfect age to learn about the justice system. Giving the students a front-row seat in a real courtroom helps them understand the impact people’s bad decisions have on others and on our community. We also hope to inspire these kids to become the next generation of lawyers and law enforcement professionals.”

To support the lessons in Judge Herndon’s script, Project REAL created three days of presentations and supporting worksheets. Project REAL’s staff then presented the lessons to the students of Rundle Elementary with support from their teachers. These activities prepared students for their Harry Potter experience by teaching them basic law-related vocabulary, trial procedure, and the roles and career opportunities available in the justice system.

A class of fourth graders got an education on the justice system when they sat through the court calendar of District Court Judge Douglas Herndon. They then got to test their chops in a court of law with a mock trial: The Ministry of Magic vs. Harry Potter. The students from the Meadows School were prepped by their teacher for their day in court. They played the roles of judges, jury, attorneys and witnesses. The fabulous fourth graders peppered Judge Herndon with questions; he in turn, grilled them about what they learned. They appeared to have learned a lot. Two more mock trials are scheduled with Judge Herndon April 18 and May 4 at 10 a.m. in courtroom 16D at the Regional Justice Center.
